Terms and Conditions

Before you proceed with your reservations and stay, please take a moment to read and understand the following terms and conditions:

       1. Check-in and Check-out:

    • Standard check-in time is at 2:00 pm and check-out time is at 12:00 noon.

       2. Early Check-in:

    • Early check-in before 5:00 am will be subject to full day charge.
    • Check-in from 5:01 am onwards will be subject to an additional 50% early check-in charge (still subject to room availability).

       3. Late Check-out:

    • Late check-out until 4:00 pm will be subject to an additional 50% fee.
    • Beyond 4:01 pm will be charged an equivalent to a full night’s stay (still subject to room availability).

       4. Occupancy:

    • Maximum of two (2) adults will be allowed inside the Deluxe Rooms, Loft Bunk Rooms and Executive Queen Rooms.
    • Four (4) adults for the mySTAY Suite and Garden Suite.
    • Visitors must be registered at the Front Desk.

       5. Smoking:

    • Smoking is strictly prohibited within the premises.
    • A penalty of PHP 5,000.00 will be imposed for each violation, along with the confiscation of cigarettes, vapes, and any prohibited or illegal products.

       6. Housekeeping:

    • Housekeeping service, including linen and towel changes, is available daily from 9:00 AM to 8:00 PM.
    • Service will be provided only when the “Make Up Room” sign is displayed or upon request through the in-room app. If the “Do Not Disturb” sign is shown, your privacy will be respected.

       7. Damages:

    • The hotel reserves the right to charge a fee for stained linens, losses, and breakages in the room for the duration of your stay.

       8. Valuables:

    • The hotel will not be liable for any valuables left inside the room as governed by the civil code of
      the Philippines.

       9. Non-compliance:

    • The hotel reserves the right to institute necessary action in case of self check-out, non-compliance, disorderly conduct, or failure to pay upon demand of an outstanding amount.

       10. Deliveries:

    • Any deliveries should be received by the guest. The hotel will not accept deliveries on behalf of the guest.

       11. Acknowledgement:

    • The guest acknowledgement and agreements on and complies with the hotel’s House Rules.

       12. Security Deposit:

    • A cash security deposit is required upon check-in.
    • This will be fully refunded upon check-out, provided there are no damages, losses, or additional charges incurred during your stay.

       13. Identification:

    • A valid government-issued ID is required upon check-in.

       14. Breakfast:

    • We also offer breakfast at an additional charge of Php 170.00nett per person.
    • This includes your choice of breakfast bento & coffee or tea for one (1).

       15. Parking:

    • Parking is limited and available only at mySTAY BGC North; to secure a slot, guests are advised to confirm availability prior to making a reservation, with overnight fees of Php 100.00 for motorcycles and Php 150.00 for cars.

Agreement to Our Legal Terms

Welcome to mySTAY Rewards. Our goal is to provide you with a seamless hotel experience through a mobile application that allows you to access essential stay information, manage your reservations, track your rewards, and enjoy exclusive member benefits.

We are Philippines Urban Living Solutions, Inc. ("Company," "we," "us," "our").

We operate the mySTAY Rewards mobile application (the "App"), https://mystay.ph (the "Website"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

Through the App, you can view your booking details, monitor your rewards activity, redeem offers, receive important updates, and access guest services designed to enhance your stay.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Philippines Urban Living Solutions, Inc., concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms.

IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

You should also review the mySTAY Rewards Privacy Policy, which is incorporated into this Agreement by reference and available through the App and our official website.

We reserve the right to make changes or modifications to these Legal Terms at any time. We will alert you about any changes by updating the "Last updated" date. It is your responsibility to periodically review these Legal Terms to stay informed of updates.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.

The Services may be restricted or unavailable in certain jurisdictions. If you access or use the App from outside the Philippines, you are solely responsible for ensuring compliance with all applicable laws and regulations in the location where you are using the Services.

2. Intellectual Property Rights

Our Intellectual Property

All information, material, and content available on the App and in the Website, existing and future, including but not limited to, trademarks, logos, service marks, features, functions, text, graphics, logos, button icons, images, data compilations and software, and the compilation and organization thereof (collectively, the “Content”) are owned by the Company and are protected by laws, including laws governing copyrights and trademarks.

Except as required under applicable law, neither the Content nor any portion of the App or the Website may be used, reproduced, republished, uploaded, posted, transmitted, distributed, duplicated, disseminated, copied, sold, resold, accessed, decompiled, disassembled, reverse engineered or modified, or otherwise exploited, in whole or in part, for any purpose without the Company’s express, prior written consent. Nothing contained herein grants or should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademarks, trade names, service marks or logos displayed on the App or in the Website, without the Company’s written permission or such third-party owner, as may be applicable.

Any content or material that you download from the App and our website shall only be limited to your personal, non-commercial use and for purposes of gaining access to our Services. Any breach of these Intellectual Property Rights will constitute a material breach of our Legal Terms and your right to use our Services will terminate immediately.

Your Submissions

By directly sending us any question, comment, suggestion, idea, feedback, or other information about the Services ("Submissions"), you agree to assign to us all intellectual property rights in such Submission. You agree that we shall own this Submission and be entitled to its unrestricted use and dissemination for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

3. User Representations

By using the Services, you represent and warrant that:

  1. You have the legal capacity and you agree to comply with these Legal Terms;
  2. You are not a minor in the jurisdiction in which you reside, minimum age 18 years;
  3. You will not access the Services through automated or non-human means, whether through a bot, script or otherwise;
  4. You will not use the Services for any illegal or unauthorized purpose; and
  5. Your use of the Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services.

4. Eligibility, Membership & Rewards Mechanics

4.1 Eligibility

Membership is free and open to all individuals aged 18 years and above who stay or transact with mySTAY Rewards or its official partners. Each member may register only one account per valid email address and mobile number.

Your digital membership ID (QR code) must be presented at check-in or during eligible partner transactions.

Membership may be suspended or revoked in cases of fraud, abuse, or violation of these Terms.

4.2 Earning Points

Depending on the membership tier, a member will earn at least 1 Reward Point for every PHP 100 spent on eligible room bookings at participating mySTAY Hotels.

Points are credited after full payment and completion of the stay.

To maintain an active account, you must complete at least one (1) qualified room night per calendar year.

Points are non-transferable and cannot be sold, pooled, or gifted between members. These conditions may be subject to change without prior notice.

4.3 Redeeming Points

Points can be redeemed for free stays, vouchers, and other rewards displayed in the app.

Redemption is subject to availability, blackout dates, and booking conditions.

Points have no monetary value and cannot be exchanged into money, credit, or refunds.

mySTAY Rewards reserves the right to adjust, cancel, or refuse any redemption suspected of misuse or system error.

4.4 Membership Tiers

Tier levels (Orange, Silver, Gold, Platinum) are determined based on annual booking activity.

Tier benefits and qualifications are subject to review every 12 months.

Perks associated with each tier may be modified or discontinued at any time without prior notice.

mySTAY Rewards reserves the right to change qualification criteria or tier benefits at its discretion.

4.5 Digital Vouchers

Digital vouchers are available via the app and are subject to validity periods and specific terms indicated therein.

Vouchers are non-exchangeable for cash and cannot be combined with other offers unless stated.

mySTAY Rewards is not responsible for lost, expired, or deleted vouchers.

5. Guests and Participating Hotels

5.1 Definitions

For purposes of this Agreement:

  • "Guest" refers to any individual who creates an account or provides information in order to access the App or participate in the Services, whether as a registered member or a non-member user.
  • "Hotel" refers to any mySTAY Hotel branch as a partner hotel for mySTAY Rewards to provide access to hotel information, services, rewards, offers, and in-app features.
  • "Hotel Representative" refers to individuals authorized by the Hotel to manage Guest profiles, stays, rewards, and related information within the platform.

5.2 Guest Registration

Guests may download the mySTAY Rewards App directly from the Apple App Store, Google Play Store, or any other authorized source.

To register, Guests must provide accurate personal information such as:

  • Full name
  • Email address
  • Mobile number
  • Password or authentication credentials

Once registration is complete, the Guest may immediately access available app features. No hotel registration or activation is required for Guests to create an account.

5.3 Guest Responsibilities

When creating an account, Guests must ensure that all information provided is accurate, complete, and kept up to date. Guests are responsible for safeguarding their login credentials and for all activities conducted under their account.

5.4 Access to App Features

Once registered, Guests may use the app to:

  • Browse hotel listings and offers
  • View amenities and hotel information
  • Explore rewards, points, or available member benefits
  • Receive notifications and promotional updates
  • Access digital services provided by participating Hotels
  • Communicate with Hotels using in-app messaging, if available

Feature availability may vary depending on the Hotel's participation level and the Guest's membership tier.

5.5 Hotel Responsibilities

Hotels are responsible for ensuring the accuracy of their property information displayed in the app, including descriptions, rates, amenities, photos, availability of offers, and contact information.

mySTAY Rewards is not responsible for misinformation provided or updated by Hotels.

6. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

  1. Systematically retrieve data or other content from the Services to create or compile a collection, compilation, database, or directory without written permission from us.
  2. Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
  3. Circumvent, disable, or otherwise interfere with security-related features of the Services.
  4. Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
  5. Use any information obtained from the Services in order to harass, abuse, or harm another person.
  6. Make improper use of our support services or submit false reports of abuse or misconduct.
  7. Use the Services in a manner inconsistent with any applicable laws or regulations.
  8. Engage in unauthorized framing of or linking to the Services.
  9. Upload or transmit viruses, Trojan horses, or other material that interferes with any party's uninterrupted use and enjoyment of the Services.
  10. Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering tools.
  11. Delete the copyright or other proprietary rights notice from any Content.
  12. Attempt to impersonate another user or person or use the username of another user.
  13. Upload or transmit any material that acts as a passive or active information collection or transmission mechanism ("spyware" or "pcms").
  14. Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
  15. Harass, annoy, intimidate, or threaten any of our employees or agents.
  16. Attempt to bypass any measures of the Services designed to prevent or restrict access.
  17. Copy or adapt the Services' software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
  18. Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.
  19. Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavor or commercial enterprise.
  20. Solicit money or financial assistance from other Guests or participating Hotels.
  21. Stalk, harass, intimidate, or threaten any individual.
  22. Collect usernames, email addresses, or any user data through electronic or other means for unsolicited communications, unauthorized linking, or commercial purposes.
  23. Forge headers, alter metadata, or manipulate identifiers to disguise the origin of information transmitted through the Services.

7. User Generated Contributions

The Services may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials (collectively, "Contributions"). Contributions may be viewable by other users of the Services and through third-party websites.

You are solely responsible for any content or information you upload, post, publish, transmit, display, or otherwise make available through the App or Services.

You may not post or share any material that is:

  • Offensive, abusive, obscene, profane, sexually explicit, threatening, harassing, discriminatory, or illegal
  • Defamatory or violative of another person's intellectual property, privacy, or publicity rights

You represent and warrant that all information you provide during registration and use of the Services is accurate, truthful, and will be updated promptly when changes occur.

8. Contribution License

You and Services agree that we may access, store, process, and use any information and personal data that you provide and your choices, including settings.

By submitting suggestions or other feedback regarding the Services, you agree that we can use and share such feedback for any purpose without compensation to you.

We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions.

By posting Content through the App or Services, you automatically grant mySTAY Rewards, its affiliates, licensees, and successors an irrevocable, perpetual, non-exclusive, royalty-free, worldwide license to use, copy, store, perform, display, reproduce, record, adapt, modify, distribute, and create derivative works from your Content for operational, marketing, or service-related purposes.

9. Your Interactions with Other Members

You are solely responsible for your interactions and communications with other Guests or with participating Hotels and their authorized representatives. You acknowledge and understand that mySTAY Rewards does not currently conduct criminal background checks, screening procedures, or verification processes on its members, Guests, or Hotel representatives.

mySTAY Rewards does not guarantee, endorse, or validate the conduct, background, or statements of any user or participating Hotel.

mySTAY Rewards is not responsible or liable for the conduct, actions, or omissions of any Guest, user, or participating Hotel. To the fullest extent permitted by law, mySTAY Rewards, its affiliates, and partners shall not be liable, directly or indirectly, for any losses or damages of any kind, including but not limited to direct, indirect, or consequential damages, special or incidental damages, emotional distress or psychological harm, or personal injury or death arising from or relating to your interactions with other users or Hotels, whether online or in person.

You agree to exercise appropriate caution and judgment in all interactions with other Guests or Hotel representatives.

You should never provide your financial information, such as credit card numbers, bank details, or payment credentials, nor send funds directly to any user except through authorized and secure payment channels provided or approved by mySTAY Rewards.

10. Services Management

We reserve the right, but not the obligation, to:

  1. Monitor the Services for violations of these Legal Terms;
  2. Take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms, including reporting such user to law enforcement authorities;
  3. In our sole discretion, refuse, restrict access to, limit the availability of, or disable any of your Contributions or any portion thereof;
  4. In our sole discretion, remove from the Services or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and
  5. Otherwise manage the Services in a manner designed to protect our rights and property and to facilitate the proper functioning of the Services.

11. Charges and Billing

11.1 Hotel Subscription Billing

mySTAY Rewards may opt to bill participating Hotels or authorized Hotel Administrators through an online billing account ("Billing Account") for access to and use of the Services. By subscribing, the Hotel agrees to pay all applicable fees based on the selected subscription plan and the payment method chosen within the App or Website.

As long as the Hotel's subscription remains active and includes Guest-facing features, registered Guests may continue to access and use the App.

mySTAY Rewards reserves the right to correct any billing errors, including those discovered after payment has been requested or received.

11.2 Chargebacks

If a Hotel or Administrator initiates a chargeback or reverses a valid payment, mySTAY Rewards may immediately suspend or terminate their account.

If a Guest or member incurs more than two (2) chargebacks within a year, mySTAY Rewards may restrict, suspend, or refuse continued membership or access to the Services.

11.3 Guest Billing

Guests are not charged subscription fees for app use. All charges related to bookings, stays, and hotel services are handled directly by the participating Hotel.

12. Transactions Between Guests and Hotels

mySTAY Rewards acts solely as a digital platform enabling Guests to view hotel information, access services, and engage with rewards and offers.

mySTAY Rewards is not a party to financial transactions between Guests and Hotels and is not liable for:

  • Hotel billing disputes
  • Rate or fee disagreements
  • Incorrect hotel charges
  • Refunds or hotel service issues
  • Payments made outside the app through external channels

All charges related to bookings, stays, and hotel services are handled directly by the participating Hotel.

13. Information Regarding Taxes

13.1 Guest Responsibility and Tax Awareness

Guests acknowledge that Hotels may be required by law to charge and collect applicable taxes related to accommodations, services, or purchases made during a hotel stay. These taxes may include, but are not limited to:

  • Value-added tax (VAT)
  • Service taxes
  • Local government taxes

All such taxes are determined and imposed by the applicable government authority, not by mySTAY Rewards.

mySTAY Rewards does not provide tax advice. Guests should consult a qualified professional if they have questions about tax obligations related to their hotel stays or transactions.

13.2 Taxes Collected by Participating Hotels

Participating Hotels are solely responsible for:

  • Determining applicable taxes
  • Applying required taxes to rates, fees, or charges
  • Remitting collected taxes to the proper government authority

Any tax amount displayed in the app is provided by the Hotel, and mySTAY Rewards is not responsible for verifying its accuracy.

13.3 Compliance With Local Laws by Hotels

Participating Hotels are solely responsible for ensuring their compliance with all local, regional, or national laws related to operating their hospitality business, including but not limited to business permits, licensing, tax registration, and safety regulations.

mySTAY Rewards does not verify compliance and is not responsible for any Hotel's operational, tax, or regulatory obligations.

14. Payment Processing Errors

mySTAY Rewards may take steps to correct any payment processing errors that come to its attention. This may include issuing adjustments, either credits or debits, to the same payment method used for the original transaction.

mySTAY Rewards does not assume liability for errors caused by third-party payment processors, financial institutions, or participating Hotels, but will take reasonable measures to facilitate correction if an error occurs within the scope of the Services.

15. Foreign Currency Operations

15.1 Currency Used for Transactions

The currency used for hotel bookings, charges, and payments ("Transaction Currency") is determined by the participating Hotel based on its location, policies, and local regulations.

All financial transactions processed by a participating Hotel will be charged in the Hotel's designated Transaction Currency unless otherwise stated.

15.2 Display or Search Currency in the App

For convenience, Guests may choose to view prices or app content in various supported display currencies ("Search Currency"). This feature is for informational purposes only.

If the Search Currency differs from the Hotel's Transaction Currency:

  • Displayed prices may be estimates
  • Final charges may vary due to exchange rate fluctuations
  • The actual billing will occur in the Hotel's chosen Transaction Currency

mySTAY Rewards does not control or guarantee exchange rates used by your bank, card issuer, or payment service provider.

16. Term and Termination

These Legal Terms shall remain in full force and effect while you use the Services.

Your mySTAY Rewards membership remains active as long as you complete at least one (1) qualified room night per calendar year.

WITHOUT LIMITING ANY OTHER PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICES, INCLUDING BLOCKING CERTAIN IP ADDRESSES, TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE LEGAL TERMS OR OF ANY APPLICABLE LAW OR REGULATION.

WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SERVICES OR DELETE ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party.

Account Deactivation

You may request to deactivate your account through the App or by contacting the participating Hotel. Your account may also be deactivated if the Hotel ceases its participation or subscription to mySTAY Rewards.

If you wish to cancel your membership without coordinating through the Hotel, you may email [email protected] for review and processing of your request.

Upon termination, you are not entitled to any refund of unused fees or benefits, and any outstanding amounts owed, if applicable, will become immediately due.

Service Credits

In the event of a system interruption or downtime affecting access to the App or Website, mySTAY Rewards may, upon request or on a case-by-case basis, issue service credits. Credits may be applied in the form of extended subscription periods equivalent to the duration of the outage. No monetary refunds will be provided.

17. Exceptions and Force Majeure

mySTAY Rewards shall not be held liable for any failure to perform, delay, interruption, or inability to provide the Services arising from circumstances beyond its reasonable control, including but not limited to:

  • Force Majeure Events: Events such as war, acts of terrorism, insurrection, sabotage, embargoes, labor strikes, civil disturbances, natural disasters, including fire, flood, earthquake, storm, or other extreme weather conditions, or disruptions in transportation, communications, utilities, or third-party service providers.
  • Software Issues: Unexpected software bugs, system errors, or technical defects that may affect the performance or availability of the App or Services.
  • Security Incidents or External Attacks: Network overloads, denial-of-service attacks, hacking attempts, or any unauthorized access or interference caused by third parties.
  • Scheduled Maintenance: Temporary downtime due to routine or planned system maintenance, updates, enhancements, or repairs.

18. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. However, we have no obligation to update you of any information on our Services. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services. You agree to check these terms and conditions for updates from time to time to ensure that you are apprised of any changes thereto.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors.

You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services.

19. Governing Law

These Legal Terms shall be governed by and defined following the laws of the Republic of the Philippines.

Philippines Urban Living Solutions, Inc. and yourself irrevocably consent that the courts of the Republic of the Philippines shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.

20. Dispute Resolution

20.1 Agreement to Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to this Agreement, the App, the Website, or the Services, including any alleged breach, shall be resolved exclusively through binding arbitration administered in accordance with the Philippine Alternative Dispute Resolution Act (R.A. 9285) and its implementing rules.

The only exception to mandatory arbitration is that you may file an individual claim in a small-claims court of competent jurisdiction within the Philippines.

20.2 Waiver of Court Trial and Class Actions

By using the App or Services in any manner, you acknowledge and agree to this arbitration agreement.

In doing so:

YOU WAIVE YOUR RIGHT TO FILE A LAWSUIT IN COURT, except for small-claims court matters.

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR ANY COLLECTIVE PROCEEDING.

All disputes will be decided by a neutral arbitrator, not a judge or jury. The arbitrator's decision is final and binding, and may only be challenged in court on very limited grounds under Philippine law.

20.3 Restrictions

The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law:

  • No arbitration shall be joined with any other proceeding;
  • There is no right or authority for any Dispute to be arbitrated on a class-action basis; and
  • There is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

20.4 Exceptions to Arbitration

The Parties agree that the following Disputes are not subject to the above provisions concerning arbitration:

  • Any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party;
  • Any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and
  • Any claim for injunctive relief.

20.5 Enforcement of Arbitration Decisions

Any action to enforce, confirm, modify, or vacate an arbitration award may be brought in any court of competent jurisdiction within the Philippines.

If, for any reason, the arbitration agreement is found unenforceable, any legal action against mySTAY Rewards, other than small-claims actions, may be filed only before the Regional Trial Courts of Makati City, Metro Manila, and you irrevocably consent to the exclusive jurisdiction of those courts.

21. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

22. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT OR THE CONTENT OF ANY WEBSITES OR MOBILE APPLICATIONS LINKED TO THE SERVICES AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY:

  1. ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS,
  2. PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES,
  3. ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN,
  4. ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES,
  5. ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, AND/OR
  6. ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES.

23. Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, THE TOTAL LIABILITY OF mySTAY Rewards TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP, WEBSITE, SERVICES, OR THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF:

ONE THOUSAND PHILIPPINE PESOS (PHP 1,000), OR

THE AMOUNT YOU PAID TO mySTAY Rewards, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

This limitation applies regardless of the form of action, whether contract, tort, negligence, strict liability, or otherwise.

TIME LIMIT FOR CLAIMS: YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE USE OF THE APP, WEBSITE, SERVICES, OR THIS AGREEMENT MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION AROSE. OTHERWISE, SUCH CLAIM IS PERMANENTLY BARRED.

Certain laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply to you, and you may have additional rights.

24. Indemnification

You agree to release, indemnify, and hold harmless mySTAY Rewards, its parent company, subsidiaries, affiliates, and all of their respective officers, directors, employees, partners, and agents from any loss, liability, claim, demand, damages, costs, or expenses, including reasonable attorney's fees, arising out of or related to:

  1. Your breach of this Agreement, including any inaccurate or false representations or warranties you provide;
  2. Your misuse of the App, Website, or Services;
  3. Any Content you upload, post, transmit, or make available through the App or Services;
  4. Your violation of any applicable law, rule, or regulation;
  5. Any injury, loss, or damage of any kind arising from your hotel booking, stay, or use of hotel services;
  6. Your participation in any rewards, referral, or promotional programs operated by mySTAY Rewards.

mySTAY Rewards retains the right, at its sole discretion, to assume the exclusive defense and control of any matter subject to indemnification by you. If this occurs, you agree to fully cooperate with mySTAY Rewards in the defense of such claim.

25. User Data

Membership in the mySTAY Rewards Program, including such activities which are related thereto such as, membership privileges shall require us to use the data that you submit for the following purposes:

  1. Account or membership administration;
  2. Usage of the mySTAY Rewards app, including its related activities such as booking and reservation, among others;
  3. Customer service and marketing activities;
  4. Promotional activities or events;

You are responsible in ensuring that that data you provide is accurate and up-to-date. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

Processing of your personal information shall be governed by our Privacy Statement (insert hyperlink) for the mySTAY Rewards app.

26. Electronic Communications, Transactions, and Signatures

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Services, satisfy any legal requirement that such communication be in writing.

YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SERVICES.

mySTAY Rewards may send you notices, including updates to this Agreement, through:

  • Email
  • In-app notifications
  • SMS, MMS, or text messages
  • Push notifications
  • Postal mail
  • Announcements or postings within the App or Website

These notices are considered effective once sent or posted.

27. Customer Services

mySTAY Rewards provides assistance and support through its customer care team. By communicating with our customer care representatives, whether by phone, email, in-app messaging, or written correspondence, you agree to conduct yourself in a respectful and appropriate manner.

For quality assurance, training, and security purposes, telephone calls between you and our customer care representatives may be recorded.

If, in our sole discretion, your behavior toward any mySTAY Rewards representative or employee is determined to be hostile, threatening, or offensive, mySTAY Rewards reserves the right to immediately suspend or terminate your membership or access to the Services.

28. Third-Party Content, Links, and Services

The App and Website may include advertisements, promotions, offers, or links to third-party websites, services, or resources. You acknowledge and agree that:

  • mySTAY Rewards is not responsible for the availability of such external sites, resources, or services.
  • mySTAY Rewards does not endorse, and is not responsible or liable for, any content, products, services, information, statements, or materials available through third-party sites or resources.
  • Any interactions, correspondence, transactions, or participation in promotions with third parties found through the App or Website are solely between you and the third party.

Use of Google Maps and Mapping Services

Some features of the App may incorporate Google Maps or other mapping services. Your use of Google Maps is governed by Google's Terms of Use, available at:

By using any mapping feature within the App, you agree to comply with all applicable third-party terms.

29. Copyright Policy

You may not post, upload, distribute, transmit, or otherwise reproduce any copyrighted material, trademarks, or other proprietary content through the Services without first obtaining written permission from the rightful owner. mySTAY Rewards reserves the right to remove content that violates these rights.

30. Miscellaneous

These Legal Terms and any policies or operating rules posted by us on the Services or in respect to the Services constitute the entire agreement and understanding between you and us.

Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision.

These Legal Terms operate to the fullest extent permissible by law.

We may assign any or all of our rights and obligations to others at any time.

We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.

If any provision or part of a provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity and enforceability of any remaining provisions.

There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Legal Terms or use of the Services.

Your mySTAY Rewards account is personal and non-transferable. All rights to your account and its contents terminate upon your death.

Digital-Only Services

mySTAY Rewards provides digital services accessible through the App and Website. We do not ship, deliver, or handle any physical goods as part of our operations. All features, benefits, rewards, and communications are delivered electronically within the App or through supported digital channels.
